The couple and baby live together but are not married. If they should marry, where will that leave the child's last name?

I am the grandmother, my son is on the birthcertificate as the dad but at the last minute, the mother gave the baby her last name, not his, as previously agreed. I worry about his rights as the father of the child since he and the baby's mother are not married.

Changing a last name is a simple court process. Both parties have to agree on the change and the judge signs the papers. No big deal at all.

Are YOU a member of the couple? That is, are you considering marrying
someone who has already had your baby and the baby's last name is currently
her last name?

If she decides to assume your last name at the time you marry, then
obviously, the child should as well.

If she does not, then if you wanted to avoid any sort of sexism, then the
child should either keep her name (he was born with that name, if she
doesn't change it, why should the child?) or put some sort of hyphenated
thingy (in which case, who's last name goes first?).

Or (and this is definitely my favorite): Flip a coin to decide if the kid's
name should be changed to your last name or stay her last name.

Personally, I think you and the mother should agree which last name you
prefer - and then everybody should change their last name to that.

I have a friend who changed his last name to his wife's because he was
tired of being teased about the last name he was born with. There were
people who thought of him as "whipped" until they heard his original
last name!

That would depend on whether the mother would want to take the husband's last name. I did when I evenutally married and changed my son's last name to his... and sometimes I wish I hadn't. Personally for me, I would keep the child's last name the same as the mother's. Unless- I was re-marrying... no need to keep changing the last names!

his legal name is the one on his birth certificate. If you marry and want to change his last name, you will have to apply for a new last name which only involves filling out a few forms.

If u should marry the mother, u could adopt the baby or hyphenate the last name: i.e. John Doe-Smith.

if it is the father that marries the mother.. a new birth certificate can be issued.or. father can have blood test and court will put child in dads name.

You can always have the childs last name legally changed. When my son was born he was given one last name, but after we went to child support another last name was added legally to his birth certificate. Its pretty simple to have done.

you legally change the child's last name. your name on the birth certificate allows the mother to change the child's name..on average its a hundred and fifty dollars and court cost and its done..

Parents can change a child's name anytime if they choose to. It's simply a filing thing and doesn't cost much.

The child's name remains the same, unless it's changed legally.
