No record of car accident on carfax, but found out was wrecked and fixed when bought from dealer. Dealer did not disclose previous damage to me. Now value is much lower after being appraised. They said dealer would have known. Is this fraud?

If it was a used car, the dealer may not have known about the prior damage. Unless the dealer fixed the car after they bought, you can not hold them responsible for knowing the entire history of the vehicle.

You said yourself that carfax did not show a record of an accident. You seem to think that the dealer should have gone over the car and tried to find the entire history. Dealers are in business to sell vehicles. You are buying a vehicle that has been owned by at least one, and maybe more people, and by at least one and maybe quite a few more, dealers.

Cars are damaged and repaired every day. If there was no insurance claim, or police report, the only ones with a record of the damage are the owner, and the repair shop. A person trading a car, or selling it to a dealer is not going to tell them about prior damage, especially if the damage was done and repaired a time ago. You are trying to hold the dealer to a higher standard than you hold yourself.

You could have, and should have, had the car checked out by your own mechanic prior to purchase. You did not, and now want to claim the dealer committed fraud by not disclosing something they may have not even known

Not all dealers do a thorough check of their vehicles so it's possible they might not have known. You should track down the cars previous owner and take them to court for not disclosing this information when they sold the car to the dealer. And if they did disclose this info to the dealer, they should be able to provide you with a copy of the disclosure notice so that you can take the dealer to court.

One thing to realize is that an accident will not go on record if it was just repaired by the owner and not reported to the dmv or by police when it occured. That's probably what happen. Even thought they probably could tell or knew that it was in an accident previously, its not officially reported and documented, so they can techanically say it has no previous history of accident. But check into it, who know they might have tampered with the registration.

I assume you are referring to a used car...In most states there is no disclosure required unless the vehicle has been totalled and then rebuilt, any other accidents and repairs are not required to be revealed-why didn't you have it checked out with a mechanic BEFORE buying it. Caveat Emptor..
