I don't know about the distracted part, but I think you can meet his guardian/parent and threaten to call them if he misbehaves.

What do you mean by average? Sounds like he may need an IEP and an evaluation. I hope you aren't a teacher. Check your spelling. He is acting out for some reason and the school has the responsibility to find out what it is.

It is a lot of work, but you can communicate with his parents and get the administration involved. You need to get some extra support on your side to get him to behave. If you only have one disobedient student, you're doing pretty well!

For mentally ill students you cannot do anything better you leave to them only try to gain their confidence by making him involve in the class-room activities.

have him tested for ADD or ADHD
