in the best interest of national security? I know about the 2 term limit. I was told he could extend his term this way.

Under limited Executive Orders created by past presidents, technically the president with the help of congress can take away virtually every right we have as citizens when a "state of emergency" is declared by the president. However, this option has never been exercised primarily because America holds its personal freedoms above all else and even in light of 9/11 and Katrina which would definitely be considered states of emergencies, the president could not really get away with taking over the country and dismissing the Bill of Rights and Constitution without a very large fight from it's people.

The term limit can be extended if voting under that state of emergency makes democratic voting impossible until voting can occur.

He can do anything he wants. However I doubt very strongly he would ever be allowed to get away with this. Throughout our history as a nation we have changed leaders during conflicts. We have had elections and we have changed congress.

The constitution has no clause allowing this procedure. The only time a president by law can declare martial law is in the case of nuclear attack. It does not mean he maintains power after a new president is elected though. We would still have a new president in January of 2009.

Yes, he can; along with powers granted to other Presidents, he has granted himself the most extensive powers of any President in our history, and he is the most likely to abuse them.

Recent developments suggest that the Bush administration may already be contemplating what to do with Americans who are deemed insufficiently loyal or who disseminate information that may be considered helpful to the enemy.

There also was another little-noticed item posted at the U.S. Army Web site, about the Pentagon’s Civilian Inmate Labor Program. This program “provides Army policy and guidance for establishing civilian labor programs and civilian prison camps on Army installations.”

Plus, there was that curious development in January when the Army Corps of Engineers awarded Halliburton subsidiary Kellogg Brown & Root a $385 million contract to construct detention centers somewhere in the United States

The Army document, first drafted in 1997, underwent a “rapid action revision” on Jan. 14, 2005. The revision provides a “template for developing agreements” between the Army and corrections facilities for the use of civilian inmate labor on Army installations.

We should know what happens 'when good men stand by and do nothing'!

There would have to be a national disaster or security situation that would threaten to destroy our country and we not even close to being in that situation. If we elect a democrat as president we may need Marshall Law by the end o his term.

FDR got 3 terms on some special law- so I guess it is possible. And Lincoln suspended Habeas Corpus in his time, and had the army shoot anti war protesters in the streets, so again I guess it is possible.
OTOH I don't think he will do it

I know martial law can be delcared but I don't think the President can stay President.
