Okay I asked a question earlier and I need to give a little more detail. I want to evict my sister. She has been living here for about 6 months and she dosen't pay rent or any bills. I gave her a 30 day notice to leave but I'm wondering did I even have to do that? I'm 32 she's 18 and we just can not live together. I am on section 8 and I was trying to give her a helping hand because she was in a bad situation. I'm not really even suppose to have anyone here but me and my kids I can get evicted because I let her stay here. She stabbed me in the back big time. And I want her to get out. Does she have any rights here? And if she dosen't move out in these 30 days do I have a right to pack up her stuff change my locks and kick her out?

I am a police officer and have to deal with this situation quite frequently..The only legal way to make her move out is to go to your local clerk of courts office and take out eviction papers..After the papers are served then she has 30 days to leave.If there is any other way i don't know of it..She lives at the residence cause you let her and this is home for her in her eyes so you can't just kick her out without her consent..The police can't even make her leave until the papers are served and requirements satisfied..

Gotta protect yourself and your kids...... an unauthorized person living in your home when you are getting Section 8, is enough reason for you all to be evicted. She can't stay there, and you have to do whatever it takes to protect you and your family. She's 18, and it sounds like she didn't appreciate what you've done for her. It's time she carried her own weight. Change the locks. Tell her she has to come and go while you are there, and give her a definite date to be out. Tell her that her stuff will be set outside the door after that date, and you WILL NOT be responsible for it. Pack her stuff and put it outside the door on that date if she hasn't moved out by then.

Give her a listing of all the local homeless shelters,,, they can feed and shelter her just as you have done,,,, and pack her bags,, and change your locks. Section 8 people will definately do that for you. They also will serve her a notice to vacate if you just ask. Just be honest with them. You had no idea this was for this long it was supposed to be for just a few days right??? REMEMBER!!Your first priority is to your children. Your sister is a big girl now and high time she start acting like a big girl. Just tell her this will be the best for all parties envolved. One day when she may or may not get her act together she may thank you for the TUFF LOVE you showed her at an early age. If not,, its her loss.
No need to involve the courts.
Your Section 8 office can be your best help.

No she has no rights, there is nothing in writing then she has nothing. you didnt have to give her the 30 days, and you have every right to change the locks and kick her out. Just be careful with her stuff, there might be some kind of law againest putting her stuff out on the street.

Sounds like you are a subletter. The landlord who is evicting the lessee may not even know that you are there, or he may be angry that the lessee allowed a subletter, and that is why he is evicting. In this case your tenancy is probably illegal and the landlord has every right to evict. You should start looking for a new place to live, and make sure the "landlord" has the right to be leasing to you.

Yes, you can kick her out. The question is should you?

While I understand you and your sister are not getting along, but if you kick her out without somewhere to go, I dont feel that's right either. You may have made a mistake in allowing her to stay with you, but dont compound it by kicking her out simply because you arent getting along. Make her get a job, make her earn her keep in the house, make her respect your rules...but kicking her out will just bring resentment unless you give her every opportunity to earn her way out. In the mean time, make her earn her stay. If she refuses, slowly remove privilidges- hate to say it, but you are now responsible for raising your sister...to a small degree.

You have to call the police to go and help her leave. If you just pack her stuff up and put it ot and somthing gets damaged or she says stolen she can legally charge you. Suck huh? So tell her to leave the next time you see her and if she says no say your going to call the cops.

You had better because if the law gets involved you could be out on your own yourself. she has no rights. The housing isn't hers, she's not on any lease, so she will need to leave and immediately.

you don't even have to wait the 30 days, just tell her to leave, if she refuses call the police and have them come and escort her out and place a restraining order on her, that simple

you change the locks and don't let her back in. Report her to the rental management as a "guest" that won't leave.
If she wants her belongings, let her have them,
