Our company is thinking of selling Greeting Cards under the name of CardJester? However recently we noticed that a company is starting up called CardMad.com They if you visit there site use a Jester's hat. We are worried about legal issues. Do you think we should use CardJester or think up a different name? I realise that if our name is trademarked and our Business regsitered as CardJester there should not be any problems. However customers may become confused at the similar brands.
Also what is the maximum you would spend on a Greetings Card?

Name it CardJester.A)You want this name,get it while it's available and register the name.
B)The fact that CardMad.com uses Jester's hat in their site is a very good thing for you and will be beneficial in the future.Means,everytime someone checks out their site,he can see that and in advertising business,a good reminding tool which is expensive and you get that for free.
C)If custumers are confused by the name,they may lose some while you earn some as long as you don't use Mad comic pic in your site!

cardmad.com is great if you have it cos it was registered in 2004. What's kept u? No problems with logos etc as long as they're not same. Suggest you trademark the name pronto as it's now in public domain!

Not sure what state you are in. In PA you can check for registered business names. Also in PA you can get exclusive rights to a name by incorporating. You can also check file a fictitious name certificate for a small price (irregardless of whether you incorporate), but that does not protect your name from someone else using it.

that is fine, although there are other names like cards4u. I would say the upmost you should spend would be 5 pounds, and you would expect a large card for this amount.

i dont see a problem as both names are different,as long as your logo is different,maybe a couple of joker cards?if the cards were good quality id spend maybe a couple of pounds
