you don't have any liability on them lol, as far as i'm concerned because the other driver is not supposed to be there, driving.
He is not authorized by any agency to drive because he has no license and proof of registration. that means, his presence on the road, driving, is illegal. you can even sue him.
He is not supposed to be there. No license means he did not passed the exams.
