Section 9, Clause 2 of Article 1 of the Constitution of the United States says....

"The Privledge of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."

**There is no rebellion or invasion in America at this time.

The duty of the Legislative Branch (as well as the Executive Branch), is to defend the Constitution of the United States of America. NOT TO CHANGE IT!

When the Republican Congress passed the detainee bill (written by McCain, Warner & Grahm), they trashed Habeous Corpus (the right to see the evidence & have due process) & written into Amendments 4 thru 8 of our Constitution. They are also not following the Geneva Convention (which is international law), or the US War Crimes Act. I'm so tired of hearing "to keep America safer".

Do you really think this is making America safer???

We only had to suspend habeas corpus once before, and it was during the civil war. i really dont think we are under any distress right now, so what could that man possibly be thinking?? now what does our broken democracy have left? Bush can deem anyone a terrorist with secret proof, detain them, torture them into confession, and use a military tribunal to choose their fate. This is sick. Not only that, but bush now has the power to choose what KIND of torture is alright. I’m sure our founding fathers just turned over in their graves; we just lost all our checks and balances. Not only that, but we have modified the Geneva convention so that it EXCUSES bush's war crimes, not so it protects our troops.

We are in so much danger, and it is not from the terrorists.

Who cares what party, denomination, or group you're from. SAVE AMERICA FOR YOUR CHILDREN, you need but open your eyes to see this man is mad!

During WW II the US had over 400,000 detainees held IN THE US without habeas corpus. We were at war then and we are at war now. Add to that the fact that these terrorists are not a 'real army' and follow NO (international) law--then NO laws should apply to them. The terrorists re-wrote the rules.

You are absolutely right, I think America has become its own worst enemy. I am not American, but I do love the people, and I feel it is time that everyone in your country takes the blinders off so the real truth can be revealed. Whatever happened to the citizens of the country being in charge of their government. I see personal freedoms slowly being taken away from citizens, not only in the US but Canada as well. I believe that sooner or later there will be anarchy.

Yes, you're right. After reading the detainee bill in length, it gives them the right to do whatever they want and not be charged for war crimes or anything else to hold them accountable.

What surprises me is McCain coming up with this and voting for it after being so-called "tortured" as a pow. What the heck is he thinking?

what exactly does "safe" or "safer" mean? It's kind of a generic term, isn't it?

Politics is a strange thing....I don't think any party could have done better. And, for a long time now I've been hearing rumblings from the middle east that they want a democrat in our whitehouse....so that the terrorists can feed the poor like in lebanon and take over.

It won't make America safer, just less free. But it will make our government more stable. Bush and anyone else involved in the interrogation and detention of terror suspects for the last 5 years cannot be prosecuted for war crimes under this bill. Anything they might have done that was illegal at the time, is no longer illegal -- the new law grants them blanket retroactive immunity from prosecution.

The current government has not one care about the constitution and has trounced all over it from the beginning. This is not the only time they have changed the rules to suit them. They also have walked all over our right to privacy and our right to protest our government - which is not only our right, but our responsability as citizens.
