Is October 31st the official holiday, or the day that your community observes halloween. The stipulation just says halloween, without any date. Would it make sense that the holiday would be whatever date the kids and I would be able to actually celebrate the holiday? Opinions are welcome, as well as if someone actually knows the legal answer to this question in the state of Wisconsin.

If it says halloween in your schedule then it means Oct 31. However since Oct 31 is a weekday this year many communites will opt to trick or treat on the prior or follwing weekend. In that case the kids would be spending trick or treat time with you

Halloween is October 31 no matter what day of the week it falls. How exactly are you going to take the kids trick-or-treating or to a Halloween party when you "would be able to actually celebrate the holiday" when every one else is celebrating on October 31?

Addendum
After I reread this I realized that I sounded harsh and I apologize for that. Where I live they have Halloween parties and costume parades for the Elementary school where the kids get to wear their costumes to school that day and then they all go trick-or-treating that night after the school Halloween Carnival. I believe probably the saddest sight of that day is the kids with no costume feeling left out and embarassed because their parent did not help them with a costume. I suppose if your children are small you can celebrate at home whenever you please, but as they age they will want to do what everyone else is doing. As far as the courts go I'm sure Halloween is considered October 31.

talk to your kids, see what they would like to do. maybe your kids want to go trick-or-treating with you on the day your town celebrates, maybe they want the actual day, maybe they want a different day so you can hang out and go for a hay ride or something. afterwards, talk to your ex about what the kids said and what you decided. ideally, your town would celebrate halloween on a different day than his. best wishes!
