I am paying child support for two kids. If the kids come and want to be with me. can i do all documents for court and child support myself? Do I need a lawyer? Case is in Houston, TX. I am in TX also.

You can do this yourself and it's rather easy as long as the ex isn't contesting it. What you need to do is go to your state's website, look up the court system and download the form titled "Order to show Cause" or "Change of Placement"...either one will work. Then fill it out to the best of your knowledge, make four copies and take it to your county courthouse. They will give you a courtdate and stamp them. They'll keep one and give you back three. Then take two of those copies down to your local sherriff's department, fill out some of their forms for process serving (You'll need to know as much info as possible in regards to your ex...car. license plate no, height, weight, hair color, etc.), you'll pay their fee and they'll serve her with one copy and send you back another copy stamped as proof of service. Take your copy and the sherriff's copy to court on the day of your hearing. The judge will ask you for the sherriff's copy. At the hearing, if everyone agrees, the children will be allowed to live with you and the ex will be ordered to pay support. Everything just flip flops. However, if you don't agree on this....get a lawyer, these things get really messy once a guardian adlitem and social worker get involved.

Yes, go to the court house get the papers, file them with the court, you have to have her served, then a court date, both do not need lawyers...If she agrees then over and done, if not it may be a long process...

If your ex is gonna fight it, then yes you should get a lawyer. You also need to find out how old your kids need to be to choose a parent. If they are young, usually the court doesn't listen to them.

I suggest you first go to child support division and find information about custody cases,,,keep in mind that if your ex wife gives consent then you can have an easier case,,,kids over 14 are usually allowed in the decision process,,,,,good luck my friend!!

You probably can not do it yourself. It would have to be legal & filed with the court system.
