I live in Texas and need advice, my husband died and was living with his daughter at the time. I have been legally married to him for over 20 years. He is 78 Years of age and I am 56. Will I be able to draw off his Social Security? His daughter refused to let me see him at her address. I could only visit him at the day care center. I am disable status as well. He died 3 days ago and the family did not notify me. They have gone as far as to make funeral arrangements already without me. If I am his legal wife how can they go through these preceding without my approval. Please help?

No sense of worrying about that now cause he gone and they are going to pay to bury him so you won't have to.Go get his death certificate and go down to soc.security office and draw.You can't bring him back now.

Your husband died three days ago, and you're already asking if you can get his social security? That's just wrong. You are his wife, you should be making funeral arrangements. Why aren't you there?

I don't understand this whole situation but I would advise you to get to the funeral home and take care of things, then after an appropriate amount of time has passed call Social Security and ask about benefits.

As confusing and sad as this is, it only takes one family member to sign for a body and begin making the decisions regarding the deceased. What you need to do is gather all the information you can regarding his finances and see what is yours. Then you also need to file a copy of his death certificate with the Social Security office in your state along with your current address and information, as you will be legally entitled to the monthly benefit.

LOOK i know it hurts. MY dad died i was not invited to the funeral.WE were close. MY mother came into some more moneys. THIS may be the problem they fear you have something coming. OR a hidden life insurance policy. HOPEFULLy you can go to the grave site. THEy cant stop you there.ID apply 4 his social security benifits.

Best thing for you is to talk to a lawyer. Do you have a lawyer referral service. (yellow pages under lawyers)?
You can have 1/2 hour for free or little money. Of course Legal aide and maybe an advocacy program in your area.

your answer is not simple, the one who has the money or is named to handle his final things like a will get the final say.

You should be able to get more social security, check with you nearest office

oh girl i am sorry about the passing of your husband, his kids can NOT stop you from drawing his ss... did you guys have words is the reason he wasn't with you , need a little more detail

RUN...DON'T WALK...get your-self an ATTORNEY FAST as you can.You are at a stand still if you don,t.He,more than likely,had a written...Power of Attorney drawn up.You still have a say in thing's,but you can't say them by your-self.Get the Attorney..follow my advice...HURRY

contact a lawyer as soon as possible, if you are his first wife, you are entitled to his social security benefits ....
