I think it has something to do with the disclaimer the users agree to when they sign up.... the service provides two kinds of files: licensed files that they have the rights to, and unlicensed files that anyone could have uploaded via their service.

When you go to download an unlicensed song or other file, a box pops up saying, "This file has no license information, do you still want to download it?"

I suppose that puts the responsibility for downloading unlicensed music files on the shoulders of the user and not the company itself-- they'll argue that they have no control over what users use the service for.

limewire is illegal but they cannot really stop it because most computers nowadays change the url from where you were illegally downloading so they cant trace it to your computer
