i work in supercuts and i was written up for insubordinate, and i need to find the legal right answer

Try this site - call any of the 800 numbers on there and ask who you have to call to find out -how strict are they..? geez..

You must take a 15 minute break, but if you are only working 5 hours and not 1 minute over that, you do not have to take a 30 minute lunch break, I also work in Calif. and we just had a huge inservice on this issue, because the company will get a large fine. Your boss is not trying to be mean they are just trying not to lose their business with fines. MAKE SURE YOU DO NOT WORK 1 MINUTE OVER 5 HOURS =)

Last I checked it works like this

first 2 hrs of work requires a 10 min break

after 4 hours a half hour break is/was required.

I stopped caring about such things after I lost my job so my memory says that they might have changed /modified the law to allow people who work less than 6 hours in a day to have 2 ten minute breaks.. this is for regular sic code employment, aka a regular job like urs

According to California state law anytime a worker works over 4 1/2 hours they MUST take a lunch break! Your company can face stiff fines if not enforced!

I believe you should only get a 15 min break for 5 hours work. Look up the labor laws on the web

it depends on the company. do they require you take lunch every day? if so, then you are off duty for 30 minutes. you must sign out and sign back in on the clock. just get it straight with your boss. whatever the rules are where you work, then obviously follow them. what they are doing is documenting the fact that you were insubordinate with them. if you get written up again, then they are getting closer to legally terminating your employment.
