I am not sure what the law is where you live, but no matter: do the right thing.
Do you wish to antagonize your neighbor? Have you had problems in the past?
If the leaves drop in such abundance as to be bothersome you might discuss it with your neighbor. If cleaning them up takes up a lot of space in your garbage or uses up too many of your lawn bags perhaps your neighbor could give you a few bags.
I think that you should really consider the benefits of the tree in providing shade and adding beauty to your neighborhood, pick up the leaves yourself and wave to your neighbor as you go about your day.

I can understand how you are feeling. We live in a cul-de-sac and the wind forms a sort of pocket or something that sends all the garbage from our street into our back yard which is at the end. That inlcudes millions of our neighbours flowers, leaves and even garbage. When the houses near us were being built we had a real windy day and ended up with three or four garbage bags full of building materials! Firstly I would suggest that if you can afford it you should buy a blower vac. Here in Aus you can get them as cheap as $40. You can put them on suction and suck up all the leaves in a couple of minutes. If you don't have the time or money to do this if you can cope I would suggest raking them up and throwing them out but if it is really a problem for you I would suggest talking to them and being friendly but saying either you don't have the means of disposal or that the tree is driving you nuts because of the amount of leaves you are ending up with. Perhaps you can come up with an agreement with them. Either you clean them into a pile and they collect and dispose of them or they come over and rake for you and dispose of them or perhaps they can prune the tree or something to help you out. A lot of people answering your question have said you are being stupid but I can see your point of view but it's not worth fighting with the neighbours about it. We had neighbours who had two beautiful trees with pink flowers that inevitably all ended up under our pergola but we never said anything we just cleaned them up with the blower vac. Afterall the trees were real pretty and they didn't plant them with the intention of annoying us!!! Good luck...

Have you ever watched 'People's Court' ? No my friend. And if you do, then you are inviting trouble and maybe a law-suit and an unhappy neighbor. Better idea! Why not make a compost pile with them. You can tend to it a little or alot. Make sure to add green cuttings, like grass etc. By next spring it will be done or well on its way to becoming ultra-rich composted soil. You can turn it over often or every once in a while. The more you turn the faster it will break down.

Geez, a lot of people here assume a lot. You never said there was a tree overhanging your yard, just that their leaves were blowing over your fence. If the fence is so open that leaves can blow through, I'd ask the neighbor to come rake them up himself. Otherwise, get some landscape fabric and attach to the fence for a while so leaves can't blow through.

Clean them up yourself. You are taking advantage of the shade offered by them during the summerf (and so is your lawn and lower water bill). When we rake up leaves in the fall we are actually dealing with leaves from all over the neighborhood, so what is the big deal? If you get to the point of raking up the leaves, and you seem to have the energy to throw them back over your fence, then you have the energy to put them in a sack and dispose of them yourself.

Seems like most people are forgetting that your neighbor has his/her own reponsibility in this scenario. Sure you could just continue every fall to clean up all the leaves and never tell your neighbor, which makes you the bigger person. But you're not obligated to do this OF COURSE.

I hereby grant you permission to throw the leaves coming from your neighbors tree into your yard....BACK into your neighbors yard. NO GUILT INVOLVED. Your neighbor should actually be knocking on YOUR door apologizing BEFORE you start feeling as though you have some obligation to pick up the leaves. That would be the RIGHT thing to do. It's the principal of the matter. This small situation could cause you and your neighbor to become best buddies if there was good communication involved. I hope your neighbor reads this. (LOL)

I don't know what the law is but if you do that you will make bad friends. why not put them in your compost or in your bin,good neighbours are great to have & its not worth fighting over a few or even a lot of old leaves is it?

I would talk to them first, let them know that its a problem. Well throwing then over back, you might as well just put them in the garbage it will take the same amount of energy. But definatly let them know that you have a problem with their tree.

I think that would start a big problem amongst neighbors, when it starts snowing and it gets windy outside and the snow blows from your residence to theirs would you want them to throw it back on your property. Stop complaining and do as Mom and Dad said and rake the leaves. Stop trying to find an easy way out by throwing them to your neighbors yard. BEHAVE YOURSELF!
