There are three ways to serve a person divorce papers:
1. sever it to the person (it can be signed or not signed) just show proof of service. It will still be finialized.
2. Place an ad (divorce) in the local newspaper.
3. There is another way, but the judge needs to grant it.

This happened to me, my attorney took care of what needed to be done which included hiring a private detective... so this may cost more than you think. They finally did find him a served him, he refused to sign the papers, in the state I was there at that time was PA, I had to wait 2 years for a judge to review the case because he did not sign... if he signs the papers, it should not be more than about 3 months... GOOD LUCK, but remember all states do have different guidelines... just discuss you concerns with your attorney

If he has abandoned you and your child then you should be able to go ahead with the divorce after waiting the amount of time that is necessary especially if he does not show up be sure that you are asking for custody of your child! However you do need to talk everything over with your attorney in detail!

use an attorney. its called an unlocatable spouse. it can be done but takes a little longer. the attorney can make sure it gets done right with no mistakes. wouldn't want him showing u later when u moved on and still be tied to him.

It will go through the court system, and in due time, it will happen.It might take a little longer this way, but it CAN, and will happen. Just be patient! Good Luck!!

The family court judge will allow a "nolo contedre"(no contest) divorce.

all divorce actions have a period when it will become final after filing ... may be years though. ... try locating them through social security

It can be with him..a judgement will be placed if he doesn't show up in court..and a statement can be mailed! If he doesn't find out by that..there are ways to find him...
