It is generally established that hourly paid employees recieve two breaks & a 1/2 hour lunch per eight hour shift.
If the janitor is a contract laborer then he may just be there until he is finished whatever is on the schedual for that shift. If it isn't finished, he doesn't leave.
If the work is unsatisfactory, the customer will find another janitorial service, or another janitor.
In no case do I see how this is your concern.

I'd say leave the situation alone if only because it'll come back on you in the end. I mean, if you report someone for a somewhat minor infraction, when you try to get away with something, there will be someone waiting to tell on you. If your coworkers need fired, it'll eventually come to them and you can enjoy it then.

is it against the rules of your building to smoke in the building? then he should be reported for that. the talking is kind of a moot point and i would drop that and focus on the smoking.
