When we were paying my husbands ex more than half our pay (before we gained custody) she would have FLIPPED if we were even a DAY late and opened a wage garnishment file against us even when we were never late.

She only has to pay $300 (we were nice and only asked her for half what she SHOULD be paying for 2 kids that she dumped).....and she gave us a check post dated for the 10th (it is due TODAY , not the 10th) and asked us to hold it saying she didn't have enough $$. THis is only the second month she has had to pay us!

A-Hold it
B-Go ahead and deposit it since the kids need haircuts, jackets and such for upcoming winter months
C-deposit it and start wage garnishment
D-something else

It is only the second month and she is already being irresponsible towards her responsibility... I would not deposit the check for the purpose of using the funds unless y ou have the $$ to cover it.. you could end up paying more in fees... I would hold the check until that she stated and take it to the bank where the account is at.. this will tell you allow you to get the cash to deposit it into your account or they will notify you if the funds are not there... In the mean time I would definitely start wage garnishment... then it is the courts hands and if she continues with her irresponsible behavior they can step in... all states have different laws but where I am from they do not take it lightly if you do not pay or make it difficult for them to attach wages(such as quitting jobs, etc...) You need to do what is the children's best interest and that is to make sure that they are cared for... GOOD LUCK

I totally understand your dilemma. Been there done that. But, If you deposit it, not only would it be bad for her, extra fees and such, but your bank may charge you a fee as well. Let your lawyer take care of it. Go ahead and put a wage garnishment on her. She obviously didn't hesitate to do that to you. If she is only paying half of what she should be, and still having difficulty, where is her money going? Those are her kids also, and she needs to take responsibility.

You can shoose to hold it or do wage garnishment
but for the sake fo the kids keep the check until the 10th but talk to her about the furture & if she get nasty do wage garnishment
for now be a bigger person
not for her but for the children

I would say A for now. You need to file a child support garnishment from her wages.

I vote for A. If she doesn't have it, sending her to jail is not going to make you get it any sooner. In fact, down where the rubber meets the road, you and your husband know you're never going to collect it with any consistency. Go get the kids haircuts, coats, etc, with your own money. The kids are what's important here. If she were responsible, she would still have the kids. You and your husband are the "responsible" parents. Don't depend on money from her. Experience talking here!

I would take her sorry @$$ back to court and go for more support. She gives you all of this 'shiest' for years and now you're playing Mr. Nice-guy? S C R E W that! Stick it to her like she stuck it to you. I would make her life a living goddamn hell.

If the money is due today then it is due the fact the woman doesn't have it is not your problem. best get this settled here and now,garnishee her wages

only has to pay 150 a month for 2,
she's about 2 years behind.
but if it was me i would be in jail.
