the insurgent in Iraq are unlawful enemy combatants; they kill civilians and commit war crimes, but are still considered "enemy combatants" basicaly they are criminals fighting a war

The terrorists in GITMO are these. They are non-military, non-uniformed combatants that are figthing the US Military.

It is a terrorist that doesn't wear a uniform and doesn't swear allegiance to any nation but a cause which in this day and age is radical islam. Either convert to their beliefs or they will kill you.
