My brother and his x-girlfriend have a 3 month old daughter. They have ben living together. Two nights ago, they got in an argument and she acalled her mom to come to their house. She decided that she was going to leave him. Her mom and step dad went into my brothers home and took his daughter away from him without even letting him say goodbye to her. Her mom punched my brother in the face 4 times while she was holding the baby in her carseat. My brother didn't lay a finger on her mom. His x-girlfriend is bi-polar and has always abused my brother. He has never hit her back. She has broken his nose with a glass bottle before. Anyway, after she leaves with the baby, he gets papers served on him. It was a 50B. He now has to wait 10 days before he can see his daughter again in court. The question I have is...how hard will it be for him to get sole custody of his daughter? What will be considered in the custody decisions? His ex is psycho...how hard will it be to prove that to the courts?

Your brother should have called the cops and had his girlfriends mother arrested for assault and battery . Then he would have something to fight with in court.He should have been calling the police the whole time she had hit him then he could have proved her unfit to raise a child. But now his lawyer should get her medical records and show the judge she is bi polar and she would get visitation and that is it.Good luck.,

first you brother need to file an assault complaint with the pd. then he will need documented proof (photo's,doctors reoprts,ect, ) the the child in question is being abused or neglected
