The answer must be befor the 14th amendment to the constition to pertain to this question that way it really counts.

It's the constitution. That kind of overrides the law.

The 16th Amendment reads: The Congress shall have the power to lay and collect taxes on income, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

If you want to avoid paying taxes on your business, why not just store your money in a bank in Switzerland. It's not a crime in Switzerland. Get a numbered Swiss bank account.

the odds of being audited are about one in 110 or so. my guess is your's may be a little better than that if you don't pay yours.
