hi all hope you can help and quickley. i am seperating from my partner he has agreed that if i give him half of the profit in our house he will leave today which is great. However he wants a letter from me stating that he can stop paying the mortgage which is fine as i have to pay it anyway when he is gone. what i wondered is does any one have a letter they could post for me or give me a web site that i can get a letter from . i need the wording to state that this is a full and final payment that he has no further right to the house and no future payments or claims to the property basically i get my home he gets his money and that an end to it

the only way you can do this is to see a solicitor... he will make sure it is legally binding as well as being a witness for you cos your ex could turn round and say he's had nothing from you and wants his share again if you ever come to sell the house... PLEASE you MUST get legal advice on this dont do ANYTHING regarding the house without it...

If you are in the UK and have a joint mortgage then you be jointly responsible for the mortgage and even if you give him a letter saying he doesn't have to pay, this will carry no weight with the bank or building society that lent you both the money. The only way to sort this out legally is to transfer the property and mortgage into your name which will take time.

First off all if he is just a partner and the mortgage is in your sole name then you will not have to pay him a dime, if it comes to court it can be seen as contributing to household costs a a regular tenant would. As the whole 'common law husband/wife' crap has been abolished years and years ago. I think that splitting the house just so he gets out off your hair is not a wise decision because you only have his word on it. However, he wants documentation from you?

Go to seek professional advice on what to do. The last thing you need is a bad breakup and then to be homeless.

Go see a legal expert in marriage and divorce, if you pay the mortgage anyway your husband maybe only entitled to a smaller amount. I think your husband knows this and wants it this way. Go and see what your legal right is, i suspect that it maybe a bit different to what you think it is now.

Get legal advise first as I believe he will still be liable unless you both go to your financial institution that is providing your mortgage, and have the details changed into your name. Don't go alone on this get that advise.
