my friend bought a ex local authority house over 2 years ago, and in the whole building there is only 3 families who have purchased their house. the other 3 are still local council owned. he recieved a letter from the local council as did the other 3 house owners statin that they all have to pay £600 each towards painting the close area and sectioning the garden areas, can he claim from his insurance from this or what else can he do,this is the first time this kind of thing has arised since buying the property,

I think that it is wrong that council houses were made available for sale in the first place, another Tory grand **** up from the people charged to run this country on what I hope is the British way which is "Firm but Fair". Council houses were built for people who did not have the money to pay for a house of their own, whether they had a family young or had been thrown out of their parents homes. It should be every persons priviledge to have access to a house in this country whatever their circumstances are. The thing with council houses is that they were a bit rubbish but you had somewhere to stay until you could afford to buy your own home. I think it has been an absolutely sham what has happened and the people who were supposed to be helped by having a council house have now benefited in buying these homes and selling them for thousands more than they paid. It's a joke!!! In regard to the £600 surely that is council property and if they want to do it up that is up to them!

It's nothing to do with the insurance. He should look at the deeds of the property which was in the conveyancing paper work which was done when the house was bought from the council and see whether the council stipulated any conditions on the purchaser that they must abide by maintainance charges on the whole property from time to time. After you have done this you will probably discover that the council are correct in what they are asking.

I assume that your friend's property is a flat from what you say and that this was a leasehold sale. If so then there will be a clause in the lease that enables the Council to make service and maintenance charges. If there was no maintenance work done last year then that is why they have not had this before. Your friend can complain that the work is unnecessary or that the cost is unreasonable but the bottom line is that they will have to pay. It will not be covered by insurance.

It sounds like they have bought a flat? or maisonette,if that is the case then they have to pay towards any maintainence cost.

check the agreement if he pays a maintance charge he should not need to pay the 600
