I WAS REAR ENDED A HAVE BEEN APPOINTED A SOLICITOR BY MY INSURANCE. HAS ANYONE BEEN IN THIS SITUATION. CAN YOU HELP ME.WHAT PROCIDURES DID YOU GO THOUGH TO MAX YOUR CLAIM. I HAVE WHIPLASH SPRAINS EVERYWHERE A BROKEN ANKLE BACK AND HEAD ACHES PLUS MORE.

I don't know where you live, but here in Canada the insurance company has its lawyers and those making claims get their own personal injury lawyer to make sure that the settlement is fair. The lawyer gets a percentage of the settlement. Because these lawyers know all of the ins and outs (and because they get a piece of the pie), things move along quickly and the settlement is usually the most you can get.

I gather that you were on the motorcycle and was rear-ended by a car?

You probably should get an attorney ... but I didn't when I was rear ended. First, know that the settlement that they give you will not exceed the insured limits. Your 'pain and suffering' settlement will be based on the amount of your medical bills. You probably have plenty of bills, but also know that if the insureds limits are reached, then your insurance will take over.

You have a 'no fault' claim so it will not increase your premiums.

You probably should go to a Chiro and send the bills to your insurance. But you make the decisions based on your treatments ... too many chiro's want to ride the insurance for all its worth ... anything that exceeds the insureds plus your insurance will be paid out of pocket by you. so be careful.

Then, after all property and medical claims are settled, they will make an offer to you for pain and suffering ... dont accept the first offer ... negotiate for more ...but my experience is that you pretty much have to accept the second offer, because they wont budge much after that.

Hi, I've had 2 accidents in the last 2 years! My advice would be to keep a daily diary of the pain and suffering you are going through, this will save you having to keep re-writing things as you can just print it off when different people ask you for it.

Make sure you take plenty of photographs of the injuries.

Keep all receipts for EVERYTHING you have to pay out for, even the film and processing of the photos as you can then try to claim them back.

Also, if you can get photos of where it happened, these will help you.

Be careful if you accept a hire bike as this caused me loads of hassle with charges. Also try to find out if your solicitor is 'no win, no fee', you don't want to end up out of pocket.

I had a motorcycle accident in May of 2004. A woman ran a stop sign and I had to lay down my brand new honda cbr 600rr. I hit the pavement at 45mph with shorts and a tank top on. I had 2nd and 3rd degree burns on my arms, and huge bump on my head, and very sore hip...I got an attorney with free consultations with accidents, and within a year I received a $17,500 claim from her insurance company. So don't talk with her insurance company about anything....call a free consultation attorney 1st, and they will take it from there.....You do not have to pay the attorney if they accept your case and you loose.....if they win they get aprox 33%.....after attorney fees, money for the bike, and doctor bills, I ended up with $8200 that I was able to pocket....All of my injury's have healed 100%, and surprising enough you cannot even tell I had any road rash/burns
