I was a temp-to-hire and was promised to be hired after 13 weeks, but the company kept me on for 6 more weeks after that and it finally ended up with me losing my job. Can I still claim unemployment? Or do I loose everything because I was just a temp at that point to them?

As a temp you're entitled to collect unemployment, very much so!

The key question here is, who was your employer? What company was named on the paychecks? In a temp to hire situation, I bet you were assigned there by a temp agency. That means that until the paperwork transferred (which is sounds like it didn't) that you were legally a temp agency employee, not an employee of the assigned place.

If that is the case (temp employee), this becomes a little more complex. First of all, when your assignment ended, did you notify your temp agency that the assignment was over and that you were available for new assignments? If not, then call that agency when they first open up on the next business day and notify them your assignment ended and that you are available for new assignments.

You need to do that step in order to state that youwere available to work and that there was no work avaialable. Then you need to make sure that you follow their instructions on how to get a new assignment from them. That means to call them on a regular basis asking THEM if they have more work available. The reason you do this, is that since you are the temp agency employee, their employment requirements most likely state that you have voluntarily quit if you don't keep your status open with them. And the rule is that in this case, you need to be proactive with them and continue to check with them (don't wait for them or it gives them a loophole to say you were not seeking work).

Once you do this and if you do not refuse a different assignment offered, you need to call the state unemployment commission or go to the local unemployment office and file a claim. Then after you satisfy this information, your next step is to find out what the unemployment requirements are for each state, that is done through the unemployment office, and you need to make sure you carefully read their information and follow the state's requirements. That will mean looking for new work, not only through the temp agency but also through a job search on your own.

The unemployment claim will be against the temp agency not the place where you were assigned. Even though the assignment may have made a verbal promise, unless you have something in writing, you were not guaranteed that you would be hired.

And a final note, whether you are eligible for unemployment compensation or not, will depend upon how long you have worked and other factors, which vary from state to state.

Each state has different minimum amount of wages earned to qualify for unemployment. Just go to the state office and see if you earned enough.
