When studying the law a simple definition of its purpose was given: Laws are made to protect the rights of Americans.

Meaning that it is illegal to steal, murder or assault because that takes away a persons right not to be stolen from, murdered or assaulted. So why does a law need to be made banning same-sex marriage? How does a homosexual couple getting married take away anyone elses rights as an American?

it's a simple question that the religious crazies are making complicated
It is the state that issues marriage licenses. In the absence of a such a license a marriage in a church is not valid.
Therefore within the context of equal protection ;
What is the reason for the state to denying a gay couple a marriage license ?
All the arguments against it lead to dead ends. The fact of the matter is that the state places few if any restrictions on who can marry.
There are no education requirements
There are no ability to earn a living requirements
There are no "show a knowledge of how to raise a child "requirements
There are no rules against being a substance abuser only that at the time you got married you were sober enough to understand the consequences of your actions.
A often heard argument is that the purpose of marriage is procreation.What happens to those married couples who either by chance or by choice don't procreate ? Are they still married Will there be a time limit set in order to procreate ?
Procreation therefore cannot be made as a condition of marriage.
Another argument is that children do better in a safe and sane household where both parents are present and provide positive role models for their children. That argument is true. Sadly many American kids don't grow up in such a place .

The claim is that gay marrige is a threat to marriage. That argument lacks proof. Why do marriages fail ? It's not because of the gay couple down the block - unless of course your spouse is having an affair with a member of the gay couple down the block. It is well documented that marriages fail because of finances, infidelity,substance abuse, violence and general incompatability.
The absence of proof of the threat ,results in another dead end
. You would think that a marriage license would be at the very minimum as difficult to get as a drivers license and it's not.The fact of the matter is that a marriage license may very well be the easiest license to get in America, Scary
So once again what is the States reason for refusal ? And the only logical answer is that there is none

No, it obviously does not hurt anyone. When governments pass laws that discriminate against certain groups of people exercising their civil liberties it impedes democratic progress. Also, the issue is a blatant example of religious beliefs entering the lawmaking process. Our founding fathers explicitly wanted a seperation of church and state. Any law passed banning same-sex marriage is a step backwards in freedom.

It seems that we Americans are control freaks. (some, not all)
Marriage in the governments eyes is a contract between two people. It is not suppose to have anything to do with religion and biblical teachings... However, it seems that the people of this great nation have forgotten about the separation of church and state.
With more than 50% of all marriages ending in divorce, who are we to tell these people that their love for one another can not be recognized by the state?

It doesn't and I agree with you completely. I see no point in taking away their ability to get married. In fact, this law takes away from their right. Heterosexual couples have the right to get married and experience the joys and the downfalls of marriage. Homosexuals should have the same rights. They should be able to experience the good times and the bad times as well.
Homosexuals should have the same rights as heterosexuals, its only fair. and you are right they aren't hurting anyone, its a stupid law and it shouldn't exist.

There is no legal basis for making gay marriage illegal. I don't think there is anything wrong with being gay. I think gay people are born that way and it is impossible to "convert" people, either way.

I wish society was more encouraging of gay people getting married and having children. This would make gayness seem more normal and not such a social stigma.

Some conservatives bash gays because they live a promiscuous "lifestyle." I have a problem with promiscuous people, period. Gays should be allowed to fall in love and get married like the rest of us.

I think we would all be happier and safer that way.

well the thing is, homosexuality is a really sensitive issue, it has only these past couple of years become so big, so now we have all these people strongly against it because the bible is against it, but then you have these people who want it to be legal, so as you can see it is hard for the government to change the law, considering how sensitive the issue is. i think that they are passing it off as "its not our fault its illegal, its how the constitution was written" and as you can see how hard it would be to change the constitution, i myself am against same sex marriage mainly cuz i am christian, and because i find it gross.

Very good question! that deserves a moral and ethical answer. Where one receives his answer would depend on it being acceptable or object able. It hurts one spiritually if you were to ask one that feels superstitious. There is no way of changing ancient superstition that condemns homosexuals from a consensual relationship. Its something hopefully we will evolve from. Meanwhile, be true to each other. good day! "the budell"

Taking drugs could often be done and not hurt anyone but the user. For example, if I grow my own pot, smoke it on my own property, and don't leave until sober. But the law says even that is illegal because it degrades society. These laws were passed by democratically elected officials so they are legitimate until overturned.

That's simple then the next thing u know they want to teach kids in school all about how its OK to be gay well its not OK. Which by the way is trying to get passed in congress to teach gay education So as my right as a parent I dint want my kids to be told its OK to be gay. I would rather be able to tell them it is not morally right and wasn't suppose to be Adam and Steve but Adam and eve.! think about it God don't make mistakes man does ever think our medicines or food that has chemicals in it made gay people i don't believe god did !

The only thing that bothers me is how is it offensive to some one to have to drive by a cross on a war memorial, and get the ACLU's help. But not offensive to watch two men kissing in front of my children? I find that offensive. Will the ACLU sue them for me?
