I have a caregiver who lives with my parents. I have paid her quite well for the last year and a half but she has recently become irresponsible (recently took two extra days of vacation without telling anyone and started to feed my mom less food so that she wouldn't have to give her insulin). In addition to a salary we have allowed her to live there rent free with no charge for utilities or groceries.
I want her out but I want her out on the same day that I tell her so that she can not retaliate on my mother. Can I do this legally?

She is an employee who is neglecting your mother; fire her and request that she leave immediately. If you do not have a contract signed that states she is employed for a certain period of time you have every right to fire her immediately. Then I would report her for neglect and abuse so that she cannot do this to someone else. It is no different than firing any other employee. I would then find someone through a reputable agency.

Not only can you do this legally, but you can get her for abuse and neglect on the elderly!!

Being a caregiver is great responsibility, and if a person is not doing the job, then they need to be fired. Notify the county health and human services, and they should be able to help you out.

If she is not paying rent, I don't think legally she is a "tennant", so the landlord laws would not apply. But if you want the skinny on all of that, you need to contact a lawyer, ASAP.

Be sure to inform the Sheriff's office of the pending fireing and the reason for it and that you are concerned of your parent's safety and also call the local prosicutors office for advice first, and not just the people on the internet! And call the Health Care Facility Complaint's Dept. at 800-669-3534 in Ohio, or the federal information center at 800-FED-INFO. Good luck!

If you hired her you can fire her. Unless she is paying rent you don't have to give an eviction notice.
