i know this couple that was together for 10 years and they both use to drink and do drugs together and we all know drinking and drugs dont mix with bad tempers. they both hit each other for many of the years they were together, she stabed him hit him in the head with a hammer and one day she went at him with a crow bar....well he stoped her from hitting him ,and he then hit her a few times in the face .2 black eyes and a broken jaw . this was there last fight of the 10 years they were together....well she went to the hospital and they got the police involed. its been almost 3 years since all this (mind you) he now has a family and is engaged to be married with 2 step kids. if you were a jury in this case would you sentence him to 7-10 years in prison ? what would her consiqences be for her assults on him ?

Judging from your explanation, there currently isn't any ACTIVE criminal charges on either person in this evident dysfunctional family; they'd be stupid to think a marriage can prevent pending jail or prison sentences otherwise.

However, surely there is enough documented evidence history to prove the couple have violently abused each other--perhaps to the point where a concerned close family member can petition for protective custody of the children attached to this trashy pair.

But that's ONLY if either criminal charges of domestic violence are ACTIVE / PENDING or if there are signs the children themselves are now being targets of such abuse(s).

Otherwise, nothing is stopping this wacko couple from tying the knot and honeymooning in their cozy trailer trash nest.

tough question! No matter what drug or drink someone is under the influence of and no matter how long it has been he should be held accountable for his actions he was taking the drugs and drinking by his own choice as well as she too but unless he filed suit against her for abuse she will get nothing but if he did it will depend on the severity of her actions and what she did to him

They should both be sent to Iraq to fight for the 'freedom' of the Iraqi people.

There is no need for that crap.
If we HAVE to have a solution that fits the limited scope of the legal system, then they both should get the full 10 years for assault and battery.

Tough one...she is an abuser too. However, I am sure he was much stronger, and he probably could have pinned her down, but it is over and that is all that matters. Sometimes certain relationships can bring out the worst in people.

it is a he said she said kinda thing. she is the one that went to the ER.
did he have any marks on him? If so, were pictures taken? can he PROVE it was "self defense"? bottom line there are mandatory sentancing laws in efect for domestic abuse. sorry

NO Not at all it is not his fault...she attacked him, he is defending himself...she is the assaulter she is the one who should be sentanced
