If they just came and sneakily took them, it would be theft. Probably grand theft, although I'm not sure how much a sheep costs.

If they came up and threaten the shepperd and forced him to give up the sheep, it would be robbery.

Wouldn't that depend on the value of the sheep? Most likely, the crime would be Grand Larceny. I think that they treat the case as if it was a stolen stereo, car, etc...

Unless you could prove it, he would be probably charged with mutton. However, all ties to the community would be sheared and he'd be asked to "get the flock out of town".
