& if the person who records the cam then shares the images for malicious intent...is that legal?

You can record ANYTHING. If a person willingly gets on their webcam, and willingly logs into a public forum (such as yahoo or msn) then their right to privacy is non existant. You may record anything that comes across your monitor. At the same time, you can not republish that video or image without their permission. (Thats a copyright thing) There is a program at http://www.oatmealmedia.net that actually allows you to view webcams without the user knowing and record them. It is legal to do that because they are willingly logged into a public forum.
