In all states of this country, an adult having sex with a minor is statutory rape and the perpetrator should be reported to law enforcement. The mother is guilty of sexual abuse of her daughter by not stopping or reporting the perpetrator to authorities and she should be reported to child protective services so that her daughter can be placed where she will be safe. In most states the child doesn't have to go to foster care if there is a close relative who will commit to protecting the child from further abuse. Also in most states, if you know of such a crime against a child, you have 24 hours to report it or you can be held accountable if further injury happens to the child. Do what is right and you will be loving the kid.

The only thing that you can do is to be there for her. The more you try to convince her to leave this loser, the longer she'll stay.
