Under the Working Time Regulations 1998 all employees are entitled to 4 weeks paid holiday per year. This time can include bank holidays at present, although the government has proposed this be changed. An employer cannot refuse to pay you, tell her to make a written complaint about the matter stating that the refusal may amount to unlawful deductions from wages and that she is considering complaining to an employment tribunal on these grounds.

In British law, the holiday entitlement is 4 weeks, although there are some exceptions to which professions this covers. The employer can also choose to make these 4 weeks include bank/public holidays. It should be set out in your wife's terms and conditions of employment.

Does she have a written contract? What holidays do others get where she works? I think that it is now the law that everyone is entitled to the equivalent of four weeks hols a year.
You could speak to Citizen's Advice and see what they say. They have a website but I can't recall what the address is. I'm sure that will answer your question. Failing that, you may need legal advice. Try cls-direct.co.uk for sols in your area. Make sure you get a fixed fee interview though or it will cost a bomb.

Your wife should refer to her employee handbook which should state what the rules according to the company are regarding holiday pay. If there is nothing in there she should approach her personnel or HR department and ask them what the rules for the firm are. Depends on the companies policy.
Does she work full or part time?
How many full paid holiday allowance has she got and what has she remaining from that allowance.
If she has her contract of employment, read it. If she is entitled to holiday pay, then insist she gets the money as long as she has not exceeded her holiday allowance.
Was the holiday pre-booked?

Most companies require the employee to work "the regularly scheduled shift immediately prior to and immediately after the holiday" to be eligible for holiday pay. Vacation time generaly counts as "time worked" for the purpose of holiday pay eligibility.
"Regularly scheduled shift" is interpreted as the full shift. If she left early or was late, or if she was absent the day before or the day after she dosen't qualify for holiday pay.

under the contracts of employment act I think it has to be in writing on your contract of employment that you sign with your hours of work your conditions ect You sign one for your employer and you keep a copy and if your holiday pay ect is on it by law he must pay you the job centre will tell you or the union if belong to one google will tell you

If it is not a paid holiday, then it is not a paid holiday. There is no law stating that you have to get paid for holidays.

There is no law that states over time or vacation it is always the company make their rules and when employed the member sigh something that stated he or she has reads the sop and understand some company's are great and some suck so awful. I wish you luck and best wishes.
