my cousin gave me a cell phone that she bought 3 years ago but she never paid up the contract when she closed it . another year has passed and i wonder if i can activate this phone and use it .

I think it would be the service not the actual phone itself unless it came with the service. If it is a phone where you can have your own sim card ( not the same one) then there should be no problem. The contract will be associated with her number -sim card.

Just put a different SIM card in it. You can just buy a card from the phone company.
