We have been waiting for a rent back check from our Title company since the 13th of September. Since this Monday, we have called every day and they are avoiding us like the plague. No call backs and no checks in the mail. The RE Agent is looking into it but he is slow as molasses. Does anyone know what recourse we have to getting this check? By the way this is in California.

According to the law, the seller and buyer must sign the 'rent back' form. Once it is signed the check can be released legally. Both parties signed on Sep. 12th. So actually they do not need this much time to process. The check was cut and was waiting for both signatures. Both signatures were on the release form and the check should've been mailed already!!

Ask their accounting department for a check number & have them call the bank to trace it's whereabouts. It may have been cashed by someone (fraud). If it has been cashed, then demand a copy of the check & take it into your local Police Department & file a report. I had this happen to me 15 years ago & someone forged my signature & it looked nothing like mine! I later found out that it was my ex-husband who took the check & signed my name & put 975 in his pocket. When I presented him with a copy of his forgery & mentioned the Police, he handed me the cash immediately. This probably isn't the case with you, but my point is that you never know who will cross the line when it comes to what they think is "easy money". If you make things clear that you are ready to turn up the heat, then most white collar criminals will do backflips to cover their tracks & get you your money just to get rid of the inconvenience of having to deal with you. Call them everyday without fail & if you can, go into the office & demand to speak to the President of the Company. Good Luck! Remember, THE SQUEEKY WHEEL GETS THE GREASE!!! P. S. Some Title Companies will use a wrong address in order to hang onto your money a little longer. Be sure & ask them WHERE they sent it to & have them stop payment & re-issue a new check if it doesn't show within 30 days of issue (10/13/06).
