I moved to another address. I put my new address on the invoice but they sent it to my old address. The lady in their billing department stated that I should have notified them about my new address but did I notify by putting it on the invoice? The invoice says PLEASE REMIT PAYMENT TO: ADDRESS

It's a forgery, and the bank that accepted the check has to make it good.

Your client hasn't paid you; they are talking rubbish, blowing smoke. Send them a letter pointing out the statement above, since you are not in privity with their bank and can't pursue any of the banks involved.

Thirdly, your household insurance just might have a forgery clause. Whether it covers a business check as such is a separate issue.

Contact your local Police or Sheriff's Department (if you are outside the U.S., I don't know what your agencies are called). Talk to someone in the FORGERY OR BANK FRAUD Department & have them handle your case. This is a Federal Offense & they WILL be able to track down the person who did this & they will have to pay you back. In the meantime, your office should have insurance to cover this type of loss & they should also be filing forgery charges with the bank & the police. Talk to someone in authority who can advise you on HOW your company should be handling this matter.

Find out from which bank the check was cashed. The company that wrote the check should be able to give you that information. Then contact that bank and tell them that they cashed a forged check. It is their responsiblity at this point. The cashed checked was either deposited (stupid person) as a third-party check, in which case the bank can determine quickly who cashed it; or it was cashed out for cash, in which case and ID check should have been performed. Either way, the bank that cashed it should be liable and should give you your money.

You should report this to the police official. You should also contact the billing department where your check came from and notify them again.

You are right, they should have changed it on their end, it wasn't your fault. Since that idiot that lives there now thought it would be a good idea to open your mail (which is a felony in IL) and cash your check (forgery)...I would definately make a police report and have them check it out. They may be able to help you get your money back.

Sounds like money lost. If the check was properly made out with your name or your company's name....you could file charges with the police....you need to determine how the check was filled in....if it is vague...the money is gone...but if the check was specifically made out to you, then you must go to the police and have the payer obtain the check for police evidence....but you also should allow time for the postal system to return refused mail...and also time for any check to clear the bank....the payer can check.

No check gets written to an address. Your name had to be on it and if someone else cashed it this is illegal. The people who owe you the money still owe it to you. Regardless of whether they gave a payment to the wrong payee.
