If I have an option to renew Janitorial services for two years. And it says to be mutually agreed upon between the county and the contractor. I know that mutually means both but what if they decide they don't want to renew with out talking to me. Then did they violate my contract? Are we suppose to mutually agree even if they don't want to renew.

Once they sign the contract the mutual part is over with and it becomes a breach of contract if the unilaterally sever the contract with out you consent.

You have an option to renew. THis means you can request a renewal. It must be mutually agreed upon. This means you can request to renew the contract but they have the right to deny the request. It also means that you have the right to deny renewal. If they decide they do not want to renew, they are not violating anything because it must be mutual, that gives both parties the right and decision to renew or not renew. Any professional would place in writing the decision to renew or not to renew. Most often there will also be an explanantion of why the decision was made. Finally, your last question/comment...if they do not want to renew then that is all it takes. It takes two yesses to renew but only one No not to renew. If one party does not want to renew then it does not matter if the other one wants to renew. I think you are trying to read into this too much. It is very simple and self explanatory. Relax, breath deep and reread this. It will be much clearer. It is just a basic contract agreement. It was designed do that it could be a success. Team work must work on both sides. if both parties are not ahppy, it is best not to deal together.

MUTUALLY Meaning: agreed by ALL participants by the very meaning of MUTUAL which indicates that ALL participants must be party to and bound by that agreement. Any "agreement" made by just two individual parties/persons where there are several participants, cannot be a mutual agreement and is unlawful and not in keeping with ethical practices.
