Who is responsible for my stolen check if the person who wrote me the check sent the check to the wrong address when I had on the invoice for it to be mailed to the other address? Am I suppose to take care of this or is it there responsibility? Someone cashed the check. Should they send me a check because I never recieved payment from them.

How did someone manage to cash a check that was not made out to them?

The maker of the check should arrange to have this check returned by their bank to the person or place that cashed it.

What do you mean by "other" address? If they mailed it to one of your two addresses, it's hardly their fault that someone at one of your addresses is a thief.

I wouldn't count on you getting your money until they get their money back.

You can file a report with the police and then with the bank they cashed it at. They had to sign the check to cash it which means they forged your signature. They person who sent it to the wrong address should repay but don't hold your breath.
File the report because cashing the check is a felony. If they don't do a new check then file a complaint agianst them for failure to pay. Or take your stuff back.

The issuer is responsible for replacement of the missing check if he sent it to the wrong address. If the check was forged that's a claim he has against his bank.

Something about your question concerns me, however: Your use of the term "other address." This indicates that there are more facts to your scenario than you have told us. If the issuer had reason to send the check to another address, he may not be liable. Suggest you see a lawyer & tell him/her all the details.

All you should have to do is prove you did not sign the back of the check. If they did not send it to the right address then again it would be their error. You will need a police report that you did not sign the check and that it was stolen and someone forged your name. The cops may make you sign your name a few times to prove your signature.

If the check issuer sent his check to the wrong company address, he needs to contact his bank to prosecute the person who ended up with the check. I would hope that the check was made out to the correct party and that name was different from the person who endorsed it. That's forgery and the person who sent out the check needs to handle it.

You are due a new check for services/product.

Yes, they should send you another check.
They should be investigating who cashed the other check also.
Have you reported it to the police or notified them?
