My friend's wife lied to him about when she was taking birth control. He has evidence that she did not pick it up from the pharmacy for the last two months. Is this a crime? How does this affect child custody and divorce proceedings (he has other children with her)?

1) Girls lie about being on birth control ALL the time...I don't think it's considered a crime.

2) he has no idea whether she went to a different pharmacy or not.

3) it won't matter much in the divorce and child custody proceedings. It might give him some small grounds to bargain with, but it's not a big enough thing to give him any real advantage. If he wants custody of those kids he's going to have to find something better.

It is not a crime in the legal meaning of the word and does not form grounds for divorce. It is, however the most disgusting breach of trust in what should be the most trusting of all forms of relationship. It is grossly unfair for a woman to put her desire for a child above the need to maintain her marriage. Forcing another child on her spouse in this underhand way and against his will is a sure way to destroy the relationship that is required for her children to grow up in love and safety.

i dont know if its a crime or not...... but as far as custody ummmm i think it would be hard for him to say that he didnt want the child to be concieved and he's putting charges against her for that.. yet he wants custody of that child???? he's already proving he didnt want it..and as far as it being born under false pretences.. i doubt a judge would do much about it.. because he should take precautions himself if he's that adament about not having a child.. u should never leave it up to someone else to protect your interests and the only 100% guarantee that u wont have a child is by not having sex at all.. so i really dont see how this will affect it to much.. but then again im not a lawyer..

Of course it's not a crime! It won't effect custody in the least! If your male or female, you should never count on any one to use birth control but your self! No excuses! If your going to be dumb, you pay the price!

It should be a crime. I've got 5 kids. 2 was good enough for me. We had a boy & then a girl. It's so bloody expensive as well. My wife said she was using contraception each time.

Not alot he can do about that except use his own birth control since she is obviously attempting to get pregnant so as to keep him around. Its not a crime.
