I might have to terminate my apartment lease earlier becos we are thinkin of buying house that is closer to work.As I read throught my lease,there's nothing about early termination fee! I don know if that is legal for not including that piece of info in the contract showing how much exactly,i called the management (by equity residential),she admit to me that there is no early termination clause in the lease we signed,but they has a "separate sheet" of paper stating that the "Current" early termination fee is 2 1/2 months rent and that is subject to change from time to time,i never being told about these and never saw this piece of paper,she later added that she'll only show it to me when i decided to terminate the lease.the lease we signed is for 1 year.Am i legally bound to pay for whatever early termination fee as set in their "separate piece of paper" ?or am i bound to pay for the rest of the rent throught out the lease? Is it legal for them to charge early termination under CA law?

CA is really bad. Unless they have changed the laws, they can even charge you throughout the term of the lease. I had a friend who signed a one year lease and moved out because he got into school housing. He wanted to sublet it to me, but the manager wouldn't let him and wouldn't let him get out of the lease. The apartment sat there empty for 6 months and he had to pay through the term of the lease. He called the state landlord tenant assistance hot line (find it in the government directories) and they told him there was NOTHING he could do. Sorry for the bad news. But, I suggest you call the hot line and get the update because this was many years ago.

Based on New Hampshire Landlord Tenant, and all the notes I have taken from TV courts..(dont laugh, they follow the law of their state on those shows) A contract is a meeting of the minds on an agreed thought. Your lease is that agreement. Any extra papers brought into the scene after the fact are not legally binding. You are legally responsible for the rent of the balance of the lease. Say per lease you rent for a thousand a month. You move early after 7 months. You are liable for 5 months or 5000 dollars. Even if they find another tenant and rent the property again. I am not a lawyer, just well versed in landlord tenant relations in New Hampshire and Florida.

Generally the early termination is the remainder of the lease, that is the purpose of the lease. You agree to pay X amount of dollars for X amount of months

Whenever a document is altered or added to, you have to initial that you accept the changes. Let her take you to court, she'll lose. Counter sue for lawyers fees (if any) --small claims court doesn't have lawyers, and any missed work from court appearances. You can't sue for pain and suffering in small claims, only actual damages.
