I'm assuming you are speaking about executive recruiting in the U.S.

A few things to start with:
- You business entity, incorporate, LLC etc.
- Build a web site
- Networking with other recruiters
- Fast computer (best if laptop)
- E&O insurance
- Find a cheap long distance calling plan and/or cell phone
- Good candidate tracking software system
- Good email application (you will need to archive all email correspondence)
- Fax capability (whether eFax like or via land line)
- Contract templates for various occasions
- Candidate interview templates
- Company job order interview templates

Legally, the most important thing is to keep track of all candidates of where they came from and where they are going.

Contact your local courthouse to obtain the answers to your question. I believe all you will need is a business license but you may need a special license for recruiting.

Just start to at least test the thing. Why would you want to pay hundreds of dollars if you're not even sure it's going to work?
