I am trying to find any State law or City Ord. that requires someone to show proof of identification when filling a prescription for a Scheduled or Controlled Substance at a Pharmacy. I have tried findlaw.com and other simular sites but can't find one. I want to find one to model after so I can try to draft one for my city. There is a nation wide problem with people passing false prescriptions because pharmacists aren't required to ask for ID and most that I deal with are too lazy to ask. I would be greatful with any help you can offer.

We currently have laws that cover the precursor to methamphetamines which cover the OTC drugs but I am looking for something that is for prescribed medication. The law in Maine is close but it says that the Pharmacy MAY check ID and doesn't say they are REQUIRED or SHALL check ID which is what I am looking for. When it states MAY the pharmacist has the choice to check but does not require them to.

R 338.3162 Dispensing by pharmacists; delivery of controlled
substances.
Rule 62. (1) A controlled substance shall be dispensed by a
pharmacist or a pharmacy intern in the presence, and under the
immediate supervision, of a pharmacist.
(2) A pharmacist may require identification of individuals to whom controlled substances are delivered.

look up "(insert your state) board of pharmacy" on a serach engine, lots of state boards post their laws online.

honestly i dont think it would help because a lot of people use their real name, usually we catch people because either 1) they are getting a large amount and dont want the script to be run on insurance which sets off a red flag to us (insurance will reject their claim if they fill it more than once a month at multiple pharmacies) or they are getting a refill way too soon 2) the Rx has a weird dosage for the meds or it looks fake or 3) they seem nervous/tell a story that doesnt make sense/contradict themselves or 4) the person has filled it many times and it is something that is usually used for a short time (like powerful pain meds) so we call the doc to make sure they are still supposed to be on it


usually if any of the above 4 things i mentioned occur, we call the doctor to verify the script is valid. and like i said its pretty common for people to use their real name on a fake Rx anyway. but i dont beleive there is any federal law that requires people to show an ID, though some pharmacies do it as policy and it might vary state to state
