Someone at my school,stabbed someone with a pencil and the one who stabbed the other person got sued today and was charged with battery and assult with a deadly weapon.

The one who got sued is pressing charges.But the catch to this,is the one who got stabbed was poking and hitting the other one who stabbed him.

yes there is a legitimate assault there,as for the deadly weapon lead can travel through the blood stream and straight to the heart causing heart poisoning which could result in heart attacks and even death.Even though the stabber was being antagonized the courts believe you should take non violent steps to resolve the situation especially in schools who implement the 0 tolerance law.

It can be done, but I can't imagine it will amount to much. Any decent judge will see that this was mainly kids, acting like kids. The difference will be in just how intensely the 'stab' with the pencil was. If it went in 3 inches...that wouldn't be good. If it was just a poke, not a big deal.

poking and hitting is a bit different to stabbing someone with a pencil. My advice is to get the hell out of your school and not to worry about who can be sued for what. YOU MAY BE NEXT..

If the other person was causing bodily harm then they should file a suit against the person who stabbed him with a pencil. If it was just picking like verbal abuse then the person who stabbed him deserves to be charged because he shouldn't have done what he did.

You can sue for anything. Doesn't mean you'll win.
I suspect anybody who did the stabbing could be held liabable for damages if someone was injured. I'm not sure it really is a "deadly weapon", though.

Like others have said, you can sue anyone for anything, but you won't necessarily win.

Just for the record, I voted down the "lead poisoning" answer because there's no lead in a pencil. It's clay and graphite (carbon). Otherwise it seemed okay. I just hate when people spout off without checking their facts. :P

the person that got stabbed may lose in court, because he/she caused themselves to get stabbed

You can sue anybody you want to, all you have to do is file the charges. Proving it is a different story!
