Yes. Taking a knife into a gun fight to be the "better man" is stupid. If the enemy brings a gun, we should bring a bigger, better gun.
When survival is at stake, you do whatever it takes, or you end up dead.

It's hard to understand what you're saying. But you are aware, aren't you, that the Supreme Court ruled a few months ago, and a few years ago, and several other times over the past decade that anyone held in US custody gets constitutional protections, and any 'enemy combatants' held are covered by the Geneva Convention.
You have actually read the relevant laws, haven't you?
