the employer is asking the physician for his employee's information is it legal and if not why? what do you do?

It is illegal for an employer to ask for, or receive the medical records of an employee. An employer may only require a full medical exam, at their expense, prior to employment. The only exception is if there are Federal or State health requirements for a particular position, (such as hearing or vision standards for school bus drivers). At which point the employer can require testing on a proscribed period for the required standard.

It is only legal if the employee has consented to a release of information. If the employee signs a medical release form, then the employer and physician can legally share information.

It depends. If the patient signed off that a third party can obtain this information then the information will be sent to the employer. If the employer is paying for the physician visit technically they should be able to. If you just called out of the blue and asked for a patients information it is illegal for the doctor to give that information.

NO. HIPPA Act. A federal law that prevents patient information being released without consent of the patient. Releasing the information could cost you your job and a lawsuit along with any fedral charges.

No, it's totally illegal unless the person who's information it is signed a release for. The consequences are pretty severe, you can also be sued - and you will have to pay dearly for that. I would contact the patient immediately. And if you did give the info. I would contact an attorney to defend you!

Do you the privacy act the employer is not privy to that information. The only information they are able to get is if they send you for drug test and a physical.

in some states it is illegal to provide personal info.. it could be possible only if you get permission of the patient to be given to employer
