the employer is asking the physician for his employee's information is it legal and if not why? what do you do?

Legallly the dr can't give it out, unless the employee signed a waiver saying it was ok, or a lawyer has a subpoena signed by a judge requesting that info. Ah, forgot about the first response, that would be another scenario where it was ok, like a pre-employment physical type of situation.

Unless the medical exam was endorsed by the company, no employer has the right to know information regarding a patient without the expressed permission of the patient. Doctors get sued over these issues.

It is legal to provide an employer with a patient's information if the patient signs a release first. This is HIPAA!

It's only legal if the patient consents to it. Just bcause it's the persons doctor doesn't mean he can do what he wants with personal information. Either the patient consents to it or it is court ordered.
