My brother got summoned for Jury Duty, and his employer is saying that he's going to have to use his vacation days in order to attend jury duty. Isn't this illegal? If it is, how can he fight this? What phone number, e-mail address, or website can he use? We live in the state of California.

My advice is for ya to contact the following places:
California Atty General's office, California Labor Dept.
U.S. Dept of labor (wage and Hour division). Can ya also
contact your company's HR to talk to them about your
brother's summon to jury duty. I believe ya supposed to take the summons to your boss and the company has to pay him time off
and still keep his vacation and vacation pay. Contact the offices I
mentioned or get a lawyer!!! Contact also the U.S. Equal Opportunity Employment Commission in CA.

You need to check around for laws regarding this in Cali. Also, check HR policies on this. Usually, there is also a chance to get out of Jury duty if it causes an unusual burden to you---

"State law does not require employers to compensate employees who are absent because of jury service. Many employers do, however, have jury-leave policies that provide compensation to employees for the time they are needed at court for jury service."

I'm in Nebraska and just got called and got a pamphlet of juror rights. It said my employer cannot penalize me in any way except to take out the $35 per day I am paid for jury duty. Try calling the attorney general's office in your state.

Call your local courthouse and explain the situation. They will able to tell you your rights regarding jury duty. Usually the court pays you a "token" fee per day and the company has to make up the difference.

I would have your brother check with the court when he appears for Jury Duty as to the state laws and such. They vary and different companies have different rules reguarding Jury Duty.

Check with the employer's human resources dept. Check with the court that selected him. The court may know where to referr him.

he can look up california laws on google, there should be a gov. website that post all of them. i think it's illegal also.
