In my personal opinion I would say 12-13. I wouldnt want to force my child at any age to go with thier father or anyone for that matter. But I believe in a cout room at the age of 13 a child does get to voice his her opinion but if the mother is feeding stuff to the child then there is a serious problem!!!!

In the state of Nebraska the child can't legally choose not to visit their other parent's home until 18 (I just asked my lawyer that last week). They cannot legally live with the other parent unless the court makes it legal until they're 18. Sometimes the court will hear their testimony, but they don't have to side with the child at any age under 18. I have a friend who's son is 12 and they had him testify that he wanted to live with his dad and thought it would happen. Their lawyer even told them it was a done deal. But when they went to court the judge ruled the kid had to stay with his mom no matter what the testimony from the kid. My friend even has a real nice home, stable family, and the kid has a ton of friends and can be in sports if he lives with his dad. Living with his mom he has to share a bedroom with her and they don't have a refrigerator or stove and cook only with a microwave. He can't be in sports. The judge still ruled that he live with his mom. So it all depends if the judge is having a good day or not, I guess.

In most states the age is between 12 and 14. However the parent whom the child lives with should talk to their son/daughter to find out why they don't want to visit. There may be a bigger concern going on or they may just not like the rules of the other parent. I think once you know the reason behind it you can determine for yourself whether the child should or shouldn't go for visitation.

When I was a child both of my parents got divorced and I was able to choose which parent I was able to live with, but only if I was of the age of 12.
It may have changed in so many years, but if it hasn't they can choose leagally at the age of 12.

Legally in Kansas it is 14 however personally i think when the child is at the age of saying they don't want to go there, i lived with my stepdad and mom until i was 17 and i hated it my mom was never home and my stepdad ran the house like a military. When he/she decides don't look down on them for it i am sure they have a reason for their decision.

I think when a child is able to understand what is going on in his surroundings they should be able to choose. Some children's ages may vary, because children mature at a different age. You know your child, and if they keep giving you reasons for not wanting to go to the other parents house, you have to check that out yourself. Children are very perceptive, they understand more than we think.

It depends on the reason why the child doesnt want to see a parent.
If a five year old says that they dont want to see a parent because they dont get ice cream everyday the five year old should go. If a five year old says that they dont want to see a parent because the parent hurt them they are old enough to not have to see that parent.

14-16 is usually the point where Judges will take them seriously and not think it's being influenced.

I was 12 when I told the judge I would rather be with my grandparents because my mom was messing up w/ drugs and stuff. Within days I was at my grandparents house.

Depends on the child. If they are already saying that they aren't going to somebody's house they are old enough. If they don't want to go to dad's house or example, there's a reason. Fiind out what that is.
