Can I use an e-mail obtained from my wife's account if she gave me the password? We are in a child custody battle and information on her account show she acts in a reckless manner.

Did she give you permission to read her e-mails? If you are obtaining electronic data from a computer without the permission of the owner, you may be in violation of federal laws.

Whether the information that you obtained is admissible, if you obtained it through violation of federal law, is largely up to your judge. However, the judge may be duty bound to report the violation to the appropriate authorities, in this case, the FBI.

If your wife gave you the password to her e-mail account I would argue that she has given you permission to use her account.

You should be able to use e-mails as long as they were composed by either yourself or your wife. If the e-mail was composed by a third party and sent to your wife, it would be considered hearsay unless the third party was present in court to testify about the e-mail.

unless you know the password you wont be able to do so.

futhermore, in any court room, any illegal form of obtaining evidence will not be allowed at all.
