I agree with you that some places will always attract smokers, and they should be allowed to light up if the company wants their business, ie bars, bowling alleys. But I disagree with you when it comes to restaurants. I used to be a server, and had no choice when I had to wait on smokers. Being a non-smoker, I can't stand the smell of smoke getting on my clothes, hair, in my lungs, and for shifts of 4-6 hours. Recently, in my state, they have banned smoking in most establishments, but the owner can still have a smoking section if it is well ventilated and inspected. And some do. I think it's the point that everybody knows that smoking can kill you and that in a public place that you should be able to choose if you want to be around that or not.

Second hand smoke most certainly kills. Just ask either the American Cancer Society or the American Lung Association.
As far as the cause of death entry on a death certificate is concerned, the cause of the cause is never listed. You would never see lung cancer caused by second hand smoke, or emphyzema caused by second hand smoke. You wouldn't see blunt force to the head because the person was hit by a baseball bat on a death certificate either. You would just see blunt force trauma to the head. Period. Nor would you see psyrosis of the liver because the woman was a drunk either. You would just see psyrosis of the liver. Period.

What do you mean by "literally" killing you? Do you mean that you have visited a physician and he has told you that you are a terminal case and the only reason you are dying is because of your neighbors' second-hand smoke? And you have medical records to back all this up? How long did he say you have to live? I am guessing you are very young in that you think that revenge and pranks are a viable way to resolve your problems. Because all that will do is cause more problems as your neighbors retaliate--you didn't think your childish games would make them stop, did you?--and the revenge and pranks escalate until someone gets hurt or goes to jail. Have you thought about closing your windows?

Yes, second hand smoke really does kill. It has been identified by the Environmental Protection Agency to be a cause of cancer in humans.Secondhand smoke causes approximately 3,400 lung cancer deaths in the U.S. a year. If you don't believe me check out sites like: www.lungusa.org or lungaction.org

Question: Does 2nd Hand Smoke really Kill?
Answer: Yes, but in relation to Jet Engine Exhaust
Emissions it is really a trivial matter. The exhaust gases
produced by one diesel truck moving up a city street
is enough poison to kill 200 men.

Yes. The last figures I saw were 10 years old, but they put it at around 3,000 deaths per year in the USA.
So it would seem that unless you've been married to a chain smoker for the last 40 years, you're perfectly safe.

Communities that ban smoking in public places have seen heart attack rates drop by up to 40%. In one case, when opponents to the law were able to have it rescinded, the heart attack rate went up to the old level.
You do the math. If you think that 2nd hand smoke doesn't kill, are you willing to have a heart attack to prove it?

I don't think there is a single proven case of second hand smoke killing someone.
