I moved in to an appartment in May and the gate has only been working 30% of the time. For the last 2 months the gate has been totaly broken. In the lease it doesn't say anywhere about the gate. Would there be a way to find out if I can get a credit on the gate??

I live in Florida

its a security gate that i have to use a clicker to open it and/or a guest has to call so I can open it for them. That was one of the reasons why i moved in cuz of the security gate.

Patricks method is about the best shot you have. The other option would be to turn this into a safety and security issue.

If you say that the only reason you moved into the complex was the fact that it was a secure and gated community you may have a shot at breaking the lease. If you can get one or more neighbors to go with you on this you may get enough leverage to force the repair.

The landlord is under no obligation to credit you for a broken gate. (You dont mention if it is a garden gate, or a Driveway gate.)
You need to send your landlord a certified letter, return receipt, demanding that the gate be fixed within a reasonable amount of time. If you can include 2 or 3 estimates from parties that can fix it, do that. If the gate remains unfixed, you can send a second letter, and state that you will pay for the repair, and remit from your rent check. State that should he not reply, you will assume that he is agreement. Should he reply, and deny your request, your last option is to fix the gate, then sue him in small claims court.

Credit? for what? Gate is not part of the dwelling even if its your access to your Apt. Is this gate soley for your use? If so you could repair it yourself and deduct it from rent but that could get ugly. First put a written work order to Landlord to fix gate. If that doesn't work fix it yourself if its that big of a deal. Don't expect him to repay you but you can charge him. Listen if it not that big of a deal forget it otherwise you could find yourself looking for a new place.

unfortunately you have a very slim chance, because the gate doesn't really change you lifestyle or have any impact on your comfort while in the apartment ...as a landlord I say dont waste your time even if you tried to sue you would pay far more then you would get back. ......VERY IMPORTANT DO NOT TRY HOLDING BACK RENT ... THE WORST THING A TENANT CAN DO ... NO MATTER WHAT THEY'LL. SIDE WITH THE LANDLORD
