I moved in to an appartment in May and the gate has only been working 30% of the time. For the last 2 months the gate has been totaly broken. In the lease it doesn't say anywhere about the gate. Would there be a way to find out if I can get a credit on the gate??

its a security gate that i have to use a clicker to open it and/or a guest has to call so I can open it for them. That was one of the reasons why i moved in cuz of the security gate.

Put your request in writing. Keep a copy for yourself. Make sure there is a validated date. A landlords have a "reasonable amount of time" to fix or make repairs for their tenant. So law actually, considers what a "reasonable amount of time is". I am guessing you fixed the gate with your own money. In the future, unless the landlord gives you that OK, don't take care of repairs on your own and except to get a credit. Of course it all lays within the written lease you signed what is the best way to handle the situation. I would also put your request in writ ting about the credit, and have proof of what was actually spent. A receipt from the store you bought materials, or a itimized list on letter head would come in handy and beneficial to you at this point. I live in Texas and all laws vary from state to state. But this is a start.

I think you need to talk to your landlord about it first. They would probably take it off your rent if you fixed the gate, but I wouldn't expect a credit for the "trials and tribulations" of not having it working.

If they advertise as a gated community, that may be something they're responsible to provide along with the usual prompt fixing of repairs and providing livable conditions for the tenants.

It never hurts to ask.

If you didn't have incidentals covered in your rental/lease agreement you might not have a leg to stand on, however you have two options...landlord tenant association and the local municipal building were you can speak to a build rep. about your landlord issue concerning the gate which may very well fall under code violation for fire code! ( fire escape ect.) If he is in violation , the city where you live will put a fire under his behind to repair or reimberse you (perhaps?)

What is the gate? Is it a security gate and it doesn't work, or what? It's kinda hard to gauge what you mean if we don't know what kind of gate it is.

you can fix the gate and how much it costs.... dock it from your rent .... give the landlord the reciept and tell him you had to fix it cause it is creating a problem for you and maintenance and repairs are his responsibilty to fix. i live in florida and it is the landlords responsibility to fix anything that is broken..... if you were renting to own then you would have to fix it on your own.... my mom is an attorney and deals with alot of slum landlords
